Benefits of mediation in divorce proceedings

In today’s article, we would like to introduce you to the benefits of ending a dispute in a divorce case through mediation. First of all, let’s start by explaining what mediation actually is. We classify mediation as an out-of-court method of resolving disputes and conflicts between parties. Mediation is an attempt to resolve a dispute amicably and to the satisfaction of both parties. Mediation is conducted with the participation of a third party, which is an impartial mediator. 

It should be noted that mediation in a divorce case is regulated by the legislator in the Code of Civil Procedure and, more specifically, in Articles 436, 4452, as well as 1831 – 18315. Mediation in a case divorce case is carried out in order to settle the disputed issues amicably. Mediation proceedings can be conducted either at the request of the parties or by court decision.

It should be pointed out that nowadays parties very often decide to conduct mediation proceedings. This is mainly because of the benefits that such a settlement of the case brings. The main benefits that the settlement of a dispute through mediation brings include, first of all:

  • Conducting mediation leads to a quicker end to the conflict and resolution of the dispute; 
  • Mediation proceedings are much less stressful; 
  • Mediation allows the dispute to be resolved in a broader and more comprehensive manner; 
  • The cost of mediation is lower than litigation;
  • Mediation provides an opportunity to work out a compromise;
  • Mediation proceedings are generally conducted much faster than court proceedings; 
  • Conducting mediation very often allows for the preservation of correct relations between the parties.

There is no doubt that settling a dispute in a divorce case using mediation proceedings has a number of benefits. Of course, the parties are not always able to work out a compromise on the disputed issues, which leads to the need for the court to resolve the disputed issues.
