Spousal support payment after divorce in Poland
When a married couple gets a divorce, the court may award alimony or spousal support to one of the former spouses.
In some situations there might be an obligation of spousal support payment after divorce in Poland. Such situations are specified by Polish law.
Spousal support payment after divorce in Poland – factors to be considered
1. The divorced spouse who has not been deemed as party soly responsible for the dissolution of marriage and whose living conditions have worsen can demand alimony payment from ex-spouse. The amount can be up to the costs of eligible living and his/her financial and material abilities.
2. If one of the spouses has been declared responsible for the dissolution of marriage and the divorce causes other spouse to suffer a considerable deterioration of living conditions, the Court shall rule, that spouse responsible for divorce shall supply for reasonable needs of the other party. This may happen even if that party does not live in poverty. The Court shall rule spousal support payment after divorce in Poland, if it was reguested by other spouse.
Spousal support payment after divorce in Poland – how long does it last?
The spouse who has not been responsible for the breakdown of the marriage is entitled to receivig spousal support payments after divorce in Poland for a period of five years from the moment of dissolution of the marriage. Furthermore, the court may prolong that period. It might be due to exceptional circumstances and upon request of the entitled party.
